Terms of Service

1. Description of Service

F.G. Web Solutions is a cloud-based financial management platform designed for Canadian businesses. The Service includes invoicing, expense tracking, tax calculation (TPS/TVQ/HST), cash flow forecasting, QuickBooks Online integration, reporting, and related features.

The Service is provided in English and French.

2. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must be at least 18 years of age or the age of majority in your province of residence to create an account.

You agree to notify us immediately at info@fgwebsolutions.com if you become aware of any unauthorized use of your account.

3. Free Trial

New accounts receive a 14-day free trial with access to PME-level features. No credit card is required to start a free trial.

At the end of your trial, your account will transition to read-only access. Your data will remain intact. To regain full access, you must subscribe to a paid plan.

4. Subscriptions and Payments

The Service is offered under three subscription plans: Essentiel, PME, and Pro. All prices are in Canadian dollars (CAD).

Payments are processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis (monthly or annually, depending on your selected billing period).

You may upgrade or downgrade your plan at any time from your billing settings. Upgrades take effect immediately with prorated billing. Downgrades take effect at the end of the current billing period.

Annual subscriptions are billed in advance for the full year. Monthly subscriptions are billed at the beginning of each billing cycle.

Additional users beyond the plan limit are billed at $15 CAD per month per additional seat.

5. Refunds

Monthly subscriptions: no refunds are provided for partial months. You may cancel at any time and retain access until the end of the current billing period.

Annual subscriptions: if you cancel within the first 30 days of an annual subscription, you may request a prorated refund for the unused portion. After 30 days, no refunds will be issued.

6. Your Data

You retain all ownership rights to the data you enter into the Service. We do not claim any ownership over your financial data, invoices, expenses, or other content.

We will not access your data except as necessary to provide the Service, comply with the law, or respond to your support requests.

You may export your data at any time using the export features available in the platform (CSV, PDF).

Our handling of your personal information is governed by our Privacy Policy.

7. Acceptable Use

You agree not to use the Service to:

Violate any applicable law or regulation, including Canadian tax law, anti-money laundering laws, or privacy legislation.

Upload or transmit viruses, malware, or any code designed to interfere with the Service.

Attempt to gain unauthorized access to other users' accounts or data.

Use the Service to store or process data unrelated to legitimate business financial management.

Resell, sublicense, or redistribute the Service without our written consent.

8. Intellectual Property

The Service, including its design, code, features, and documentation, is the property of F.G. Web Solutions and is protected by Canadian and international intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during the term of your subscription.

9. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We are not liable for any losses resulting from service interruptions or downtime.

10. Limitation of Liability

To the maximum extent permitted by law, F.G. Web Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising from these Terms or your use of the Service is limited to the amount you paid us in the 12 months preceding the claim.

The Service is a financial management tool, not a substitute for professional accounting, tax, or legal advice. You are solely responsible for ensuring the accuracy of your financial records and tax filings.

11. Termination

You may close your account at any time from your account settings or by contacting us at info@fgwebsolutions.com.

We may suspend or terminate your account if you violate these Terms, fail to pay your subscription fees, or if we are required to do so by law. We will provide reasonable notice before termination when possible.

Upon termination, your right to use the Service ceases immediately. We will retain your data for 90 days to allow you to export it, after which it will be deleted in accordance with our Privacy Policy.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of the judicial district of Quebec City, Quebec, Canada.

13. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will notify you by email or through a notice on the platform at least 30 days before the changes take effect.

Your continued use of the Service after the effective date constitutes your acceptance of the modified Terms. If you do not agree with the changes, you must stop using the Service and close your account.
